This Privacy Policy explains how Fair Home Cash collects, uses, shares, and sells your personal information when you visit fairhomecash.com (the "Site") or otherwise interact with us. Please read it carefully.
Important summary up front. Fair Home Cash is a cash-home-buying, lead-generation, and marketing service. We are not a real estate brokerage. When you submit information through our Site, Fair Home Cash may evaluate the property for a direct purchase and may sell or share the information with independent third-party cash buyers, investors, and marketing partners. Please review the sections titled "How We Share and Sell Your Information," "Your Privacy Rights," and "Do Not Sell or Share My Personal Information" below, which describe this practice and your right to opt out.
If you do not want your information sold or shared with third-party buyers, please do not submit it through our Site, because selling and sharing leads is the function of our service.
"Fair Home Cash," "we," "us," and "our" refer to Fair Home Cash LLC, an Illinois limited liability company doing business as Fair Home Cash ("Fair Home Cash LLC"). Fair Home Cash is the brand name under which we operate this Site.
Fair Home Cash may evaluate and purchase some properties directly and may connect other homeowners with independent third-party cash buyers and real estate investors. We are not a real estate broker or agent, and we do not provide legal, financial, tax, or real estate advice. We do not guarantee that you will receive any offer, that any offer will be made on any particular terms, or that any sale will close.
When Fair Home Cash buys directly, it may earn money from the property's later resale or use. When a third-party buyer or partner purchases, that party may pay us a flat per-lead or marketing fee. We do not charge sellers a service fee or commission.

We collect personal information that you provide directly to us, as well as information that is collected automatically when you use the Site. We have collected the following categories of personal information in the preceding twelve months. The CCPA/CPRA statutory categories are noted in parentheses where applicable.
We do not intend to collect "sensitive personal information" as defined by the CCPA/CPRA (for example, Social Security number, financial account credentials, precise geolocation, or biometric information) through our standard forms, and we ask that you not submit such information. If you voluntarily provide information that may be treated as sensitive (for example, financial details about a distressed property), we use and disclose it only for the purposes described in this Policy.
We do not use or disclose sensitive personal information for purposes that would require us to offer the right to limit its use under the CCPA/CPRA. If our practices change, we will update this Policy and provide any required notice and limit-use mechanism.
We do not collect biometric information. We do not create voiceprints or other biometric identifiers from call recordings. If this changes, we will provide the separate written notice and consent required by the Illinois Biometric Information Privacy Act (BIPA) and similar laws before doing so.
We and our partners use cookies, pixels, tags, software development kits, and similar technologies to operate the Site, remember your preferences, analyze traffic, and deliver and measure advertising.
We use third-party analytics and advertising services, which may set their own cookies and collect information about your activity on our Site and across other sites and apps over time. These currently include the Meta Pixel (Facebook), Google Analytics, and Google Ads, and may include other similar services. These providers may use the information they collect for their own purposes as described in their privacy policies. When you submit a form on our Site and click the button (currently labeled "Get My Cash Offer"), you provide your prior express written consent to receive marketing communications. Specifically, by clicking Get My Cash Offer, you agree to receive calls and texts, including by autodialer, prerecorded messages, and artificial voice, and email from Fair Home Cash or one of its partners, but not as a condition of any purchase, and you agree to the Terms of Use and Privacy Policy. Message frequency varies; message and data rates may apply. Reply STOP to opt out and HELP for help.
Your consent to receive these communications is never required as a condition of buying any product, receiving any service, or obtaining a cash offer. You can still contact us and proceed without providing this consent.
You can opt out of text messages at any time by replying STOP to any text, and you can reply HELP for help. You can opt out of marketing emails by using the unsubscribe link in the email. To stop calls, you can tell the caller to place you on their internal do-not-call list, and you may register your number on the National Do Not Call Registry. Even after you opt out, we may send you transactional or service messages where permitted by law.
Federal law continues to require prior express written consent for autodialed or prerecorded marketing calls and texts and artificial or AI-voice marketing calls. We retain records of your consent, including the TrustedForm or similar certificate, to document what you saw and agreed to at the time of submission. Note that we do not control, and are not responsible for, the calling and texting practices of independent third-party buyers and partners after your information is shared with them; their communications are governed by their own policies and their own legal obligations, although they are also required to obtain and honor consent under applicable law.
This section describes the core of how our service works. We sell and share your personal information with third parties, and we receive payment for doing so.
When you submit your information through our Site, we sell and share that information, including your name, contact information, and property details, with independent third-party cash buyers, real estate investors, and marketing partners who pay us for the lead. We may sell or share your information with more than one buyer or partner. These third parties are independent businesses that we do not control, and once your information is shared with them, their use of it is governed by their own privacy policies. We encourage you to ask any buyer or partner who contacts you about their privacy practices.
Under privacy laws such as the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), and similar laws in other states, our disclosure of your personal information to these third-party buyers and partners in exchange for payment is a "sale" of personal information, and our disclosure for cross-context behavioral or targeted advertising is "sharing." We do sell and share your personal information. We do not claim otherwise.
In the preceding twelve months, we have sold or shared the following categories of personal information: identifiers and contact information; commercial information; real-property-related information; internet or other electronic network activity; approximate geolocation; and inferences drawn from the foregoing. We disclosed these categories to the categories of recipients described in this section. We do not knowingly sell or share the personal information of consumers we know to be under 16 years of age.

Depending on where you live, you may have certain rights regarding your personal information under state privacy laws, including the CCPA/CPRA in California and comparable laws in states such as Virginia, Colorado, Connecticut, and Texas, among others. Subject to applicable law and verification of your identity, these rights may include the following.
Note on coverage: Illinois and Florida do not currently have a comprehensive general consumer privacy statute that grants the full set of rights below to all residents. Illinois residents are protected by specific laws such as the Biometric Information Privacy Act, and Florida residents are protected by the Florida Digital Bill of Rights only as to controllers that meet its thresholds. As a matter of policy, we extend the opt-out of sale and sharing, and we honor GPC signals, for all U.S. visitors regardless of state. We will honor other rights below to the extent required by the law that applies to you, and we may extend them more broadly as a matter of policy.
Because we sell and share personal information as described above, you have the right to opt out. To exercise this right, email us at hello@fairhomecash.com with the subject line "Do Not Sell or Share My Personal Information." After you opt out, we will stop selling and sharing your personal information for the purposes covered by your request, subject to applicable law. Opting out will not undo any selling or sharing that occurred before your request, and third parties who already received your information will handle it under their own policies. Because lead sale is the function of our service, opting out after you submit a lead may mean we cannot connect you with a buyer.
We honor opt-out preference signals, including the Global Privacy Control (GPC). If you visit our Site with a browser or extension that sends a GPC signal, we will treat that signal as a request to opt out of the sale and sharing of personal information for that browser or device, to the extent required by applicable law. Texas, Colorado, Connecticut, and California, among other states, recognize universal opt-out mechanisms such as GPC.
To submit a request to know, access, correct, or delete your personal information, use the same contact method above. We will verify your identity before fulfilling these requests as required by law. You may use an authorized agent to submit a request on your behalf, subject to proof of authorization. We will not discriminate against you for exercising any of your rights.
We will respond to your request within the timeframe required by the law that applies to you (generally 45 days under most state laws, with an extension where permitted). If we deny your request, you may appeal our decision where state law provides an appeal right by contacting us at hello@fairhomecash.com. California residents may also request, once per twelve-month period, information about our disclosures of personal information.
We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, alteration, and disclosure. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
We retain personal information for as long as needed to fulfill the purposes described in this Policy, including to operate our service, to maintain records of consent and communications as required by the TCPA and other laws, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. We determine retention periods based on the nature of the information, the purpose for which it was collected, and applicable legal requirements. When information is no longer needed, we will delete or de-identify it in accordance with applicable law. Once your information has been sold or shared with a third-party buyer or partner, that third party retains it under its own retention practices, which we do not control.
Our Site and services are intended for adults who are 18 years of age or older. We do not knowingly collect personal information from anyone under 18, and we do not knowingly sell or share the personal information of anyone under 16. If you believe a person under 18 has provided us with personal information, please contact us and we will take steps to delete it.
We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this Policy and post the updated version on this page. If we make material changes, we will provide additional notice as required by law. Your continued use of the Site after the changes take effect means you accept the updated Policy.
